1.- Legal notice and information

This legal notice governs the use of the Internet service www.editoresgalegos.org (henceforth, "website") that the Galician Publishers' Association (AGE) puts at Internet users' disposal.

The Galician Publishers' Association (henceforth, AGE) is an association whose registered address is Rúa San Marcos s/n, 15820 Santiago (A Coruña).

2.- Aim

Through the website, AGE provides users with access and use of several services and contents put at their disposal by AGE and third parties.

3.- Use conditions and acceptance

Access and use of the current website confers user status and implies the full acceptance by the users of the present conditions of use, as well as those specific ones stipulated for certain services which complement them. Moreover, users should commit themselves to using the website and the services in accordance with the law, the current legal notice, the particular conditions of certain services and the rest of the notices, regulations and instructions known by users, as well as morals, good manners generally accepted and public order.

The web pages within www.editoresgalegos.org can be accessed freely by users, excluding those that are in closed areas or require user registration. Access will be granted according to the instructions given in the service or in the particular conditions that govern it.

All the information provided by users through the services must be truthful. As far as this is concerned, users guarantee the accuracy of all the data communicated as a result of the use of certain services. Likewise, keeping all the information imparted to AGE permanently updated, so that it always corresponds to the users' real situation, will be the users' responsibility. AGE is not liable for any damage caused to third parties by the information provided.

Users will refrain from using any service for illicit purposes, prohibited in this legal notice, which might harm the rights and interests of third parties and somehow prejudice, disable, overload, deteriorate or obstruct the normal use of the services, computers, documents, files and any kind of content stored in a computer of AGE, of other users or of any Internet user (hardware and software).

In particular, by way of guidance, users commit themselves to not transfer, spread or put at third parties' disposal information, data, content, messages, charts, drawings, sound or image files, photographs, recordings, software and, generally, any type of material which:

• Somehow goes against, disdains or offends the fundamental and public rights recognized in the Constitution, in the International Treaties and in the rest of the legislation;

• Incites or encourages criminal activity, degrading, defamation, violent acts or acts contrary to the law, morals, good manners generally accepted and public order;

• Incites or encourages discriminatory actions, attitudes or thoughts on grounds of gender, race, religion, belief, age or condition;

• Incorporates, makes available or permits access to products, items, messages and/or services which are criminal, violent, offensive, harmful, degrading or contrary to the law, morals, good manners generally accepted and public order;

• Leads or may lead to an unacceptable state of anxiety or fear;

• Incites involvement in dangerous or risky actions which might be harmful to health or to emotional balance;

• Is false, ambiguous, inaccurate, exaggerated or untimely, so that it leads or may lead to errors related to the object or the intentions or purposes of the message;

• Is protected by a third party copyright or patent right and the user has not previously obtained from the owners the necessary authorization to use it;

• Infringes third party business secrets;

• Is contrary to rights, honour, personal or family intimacy or personal image;

• Somehow discredits AGE or third parties;

• Infringes the rules governing communication secrets;

• Constitutes illicit or misleading advertisement, or constitutes, generally, unfair competition;

• Incorporates viruses or other physical or electronic items which may damage or obstruct the normal operation of Internet, the system or the computers (hardware and software) of AGE or third parties, or which may damage electronic documents and files stored in the mentioned computers;

• Obstructs, due to its characteristics (such as format, extension, etc.), the normal operation of the service;

• Contains HTML tags different from those expressly authorized by AGE.

Users commit themselves to properly use the content put at their disposal in the website, namely, this list not being exhaustive, the text, photographs, charts, images, icons, technology, software, links and the rest of the audio-visual or sound content, as well as graphic design and source codes, in compliance with the law, the current legal notice, the particular conditions of certain services and other notices, rules, use or instructions known by them, in addition to morals, good manners generally accepted and public order. Furthermore, users commit themselves particularly to refrain from:

• Playing, copying, delivering, putting at general disposal or any other way of communicating in public, and transforming or modifying the content, unless having obtained permission from the owner of the rights or being lawfully permitted;

• Omitting, manipulating, or somehow modifying the copyright and other identifying data concerning the rights of AGE and of their owners, the fingerprints or any other established technical means of recognition;

• Obtaining, or even trying to obtain, the content by using means or procedures different from those put at their disposal for this purpose or those indicated in the web pages in which the content is placed or, in general, those normally used in the Internet.

4.- Inserting hyperlinks

Users and anybody intending to establish a hyperlink between their web page and the website www.editoresgalegos.org must fulfill the following conditions:

• The hyperlink will only allow access to the website home page, but will not in any way reproduce it.

• A frame on the website pages will not be created.

• No false, inaccurate or incorrect statements or instructions will be performed about the website pages and the services provided.

• It will not in any way be implied that AGE has allowed the hyperlink or has somehow assumed the services provided from the page to which the hyperlink is established.

• Excluding the signs belonging to the hyperlink itself, the page in which the hyperlink is established will not contain any distinctive sign owned by AGE, amongst those recognized by the current legislation, unless explicitly authorized by AGE.

• The web page in which the hyperlink is established will include neither any content contrary to third parties' rights nor any illicit information or content contrary to morals or good manners generally accepted and public order.

5.- Copyright and patent rights

This entire website (text, images, trademarks, logos, audio and video files, buttons, software files, combinations of colours, as well as content structure, selection, order and presentation) is the property of AGE or third parties and is protected by the Spanish and international laws on copyright and patent rights. Notwithstanding this, the website content is considered a computer program and, therefore, the Spanish and European Community regulations on this subject will be applied.

Whenever a user accesses the website, it will not be implied that the exploitation rights which exist, or may exist, on the mentioned uses are handed over, apart from those strictly necessary for the proper use of the website.

6.- Liability restrictions

To the extent permitted by law, AGE accepts no liability for any damage of any nature arising from:

• Viruses or other elements which might introduce modifications in the users' computer system, electronic documents or files.

• Content transmission, spreading, storage, offering, reception, obtaining or access.

• The absence of availability or continuity of the website and services operation, the failed meeting of the utility ascribed to the website and services by the users, the fallibility of the website and services and, in particular but not exclusively, the failures in accessing the website pages or those pages from which the services are provided.

• The correct operation of the linking technical devices (such as banners and buttons), directories and searching tools which allow the users to access websites belonging to third parties or being managed by third parties. The installation of these technical devices has the sole function of facilitating the search and access to the information, content and services available in the Internet.

• The quality, lawfulness, reliability and utility of the information, content and services existing in the linked sites.

• The use of services and content by the users or the absence of veracity, validity, exhaustiveness and/or authenticity of the information which the users provide to other users.

• The content which the users of forums or distribution lists may insert, or the opinions stated on them. AGE has no obligation to control, and does not control, the way users use the website and the services.

7.- Privacy policy

The uses and rules that AGE follows, according to the Organic Law 15/99 of 13th December, Law of Personal Data Protection, and its Development Regulation, are those expounded in this section of this legal notice.

Users are required to provide some personal data (such as name, surname, address, e-mail, telephone number, etc.) through www.editoresgalegos.org, before using certain services offered by AGE.

Your data is not included in any automated data file. It is kept for the sole purpose of responding to your question.

Should it be necessary to include your data in a file for which AGE is responsible, you would be informed in writing in order to ask for your consent. In such a case, you can exercise your access, rectification and cancellation rights by sending an e-mail to age@editoresgalegos.org or a letter to Asociación Galega de Editores, Rúa San Marcos s/n, 15820 Santiago (A Coruña).

8.- Notifications

Anything notified by a user or a third party to AGE will be considered effective provided that it is addressed to AGE by one of the following ways:

- Sending a letter to AGE, Rúa San Marcos s/n, 15820 Santiago (A Coruña).

- Sending an e-mail to age@editoresgalegos.org

If the communication refers to the performing of illicit activities or to the infringement of copyright or patent rights, documentation proving the fact as well as an express statement of its veracity should be submitted.

9.- Length and suspension of the services

AGE reserves the right to suspend the services at any time, specifically to those users who infringe anything stated in this legal notice.

10.- Applicable legislation

The current legal notice and all the relations established with AGE will be governed by the Spanish legislation.
